A power of attorney is a legal document that authorizes someone you trust to act on your behalf in financial and legal matters if you are ever unable to do so yourself.
This can include managing your bank accounts, paying your bills, handling your investments, dealing with your insurance, managing your real estate, and virtually any other financial or legal matter that needs attention.
It is one of the most practical and most powerful documents in any estate plan. And it is one of the most commonly overlooked.
The person you appoint is called your agent. The authority they have depends entirely on what the document says. A well drafted power of attorney gives your agent exactly the authority they need — nothing more and nothing less.

In Florida the power of attorney you want is called a durable power of attorney.
The word durable is critical. A standard power of attorney becomes invalid the moment you become incapacitated. That means the moment your family actually needs someone to step in and manage your affairs, a non-durable power of attorney stops working entirely.
A durable power of attorney remains in effect even if you become incapacitated. It is specifically designed for exactly the situations where you cannot manage your own affairs due to illness, injury, or cognitive decline.
Florida also has specific requirements for how a power of attorney must be executed to be valid. It must be signed in the presence of two witnesses and a notary public. Certain significant powers called superpowers must be specifically listed in the document or your agent simply does not have them.
A generic form downloaded from the internet or a document drafted in another state may not meet Florida's requirements. When that happens your agent may not have the authority they need at exactly the wrong moment.

This is the scenario I see play out with families and it is genuinely difficult to watch.
If you become incapacitated without a valid durable power of attorney in place your family has no legal authority to manage your financial affairs. Your spouse cannot access your individual accounts. Your children cannot pay your bills. Nobody can manage your investments or handle your real estate.
The only way to get that authority is through a court proceeding called a guardianship. A guardianship requires filing a petition with the court, having a judge declare you legally incapacitated, appointing a guardian, and ongoing court supervision of everything that guardian does on your behalf.
Guardianship proceedings are expensive, time consuming, emotionally draining, and completely public. They can take months to resolve. And they are almost entirely avoidable with a properly executed durable power of attorney.
I have seen families spend tens of thousands of dollars on guardianship proceedings that a properly drafted estate plan would have prevented entirely.

If you moved to Florida and have a power of attorney drafted in another state there are important things you need to know.
Florida has specific execution requirements for powers of attorney that differ from many other states. A document that was perfectly valid in New York, New Jersey, or Connecticut may not be honored by Florida banks, financial institutions, or courts.
Florida also requires that certain significant powers be specifically listed in the document. If your out of state power of attorney does not include these Florida specific provisions your agent may find themselves without the authority they need when they need it most.
Beyond the technical requirements an out of state power of attorney may simply not be structured to handle the Florida specific aspects of your financial life, your homestead property, your Florida accounts, and your Florida assets.
