A health care surrogate designation is a legal document that authorizes someone you trust to make medical decisions on your behalf if you are ever unable to make them yourself.
This can include decisions about medical treatment, medications and procedures, doctors and hospitals, surgical decisions, and end of life care.
It answers one of the most important questions in any estate plan. If you were unable to speak for yourself today, who would speak for you?
Without this document that answer is left to Florida law, hospital policy, and in some cases a court. The person making decisions about your medical care may not be the person you would have chosen. And they may not make the decisions you would have made.
A health care surrogate designation puts that authority exactly where it belongs. In the hands of someone you know, someone you trust, and someone who understands what matters to you.

Choosing your health care surrogate is one of the most personal decisions in any estate plan. This is the person who will speak for you when you cannot speak for yourself. The weight of that responsibility is real and choosing the right person matters enormously.
Your health care surrogate should be someone who knows you well enough to understand your values and your wishes even in situations your documents did not specifically anticipate. Someone who can remain calm under pressure. Someone who will advocate firmly on your behalf even when it is difficult.
It does not have to be a family member. It simply has to be someone you trust completely with one of the most important responsibilities anyone can carry.
At Bavaro Legacy Law we take the time to walk you through this decision carefully because getting it right matters as much as having the document in the first place.

This is one of the most common points of confusion in estate planning and it is worth addressing directly.
A power of attorney covers financial and legal decisions. It has nothing to do with your medical care.
A health care surrogate designation covers medical decisions. It has nothing to do with your finances.
You need both. They are separate documents covering separate areas of your life. Together they ensure that someone you trust has the authority to step in and manage every aspect of your affairs if you are ever unable to do so yourself.
One without the other leaves your family with gaps in their authority at exactly the wrong moment. At Bavaro Legacy Law both documents are included in every estate plan we create because your family deserves complete protection not partial protection.

If you become incapacitated without a health care surrogate designation in place Florida law determines who has the authority to make medical decisions for you. Florida has a statutory list of people who can serve as your surrogate in order of priority, your spouse, your adult children, your parents, your siblings, and so on.
That list may or may not reflect who you would have chosen. And it leaves no room for the nuance of your specific relationships and circumstances.
More importantly without a designated surrogate the people who love you most may find themselves in conflict over what you would have wanted. Family disagreements over medical decisions are painful, damaging, and entirely avoidable with a simple legal document.
In some cases without clear authority a hospital may require a court appointed guardian to make decisions on your behalf. That process takes time your family may not have.
Do not leave one of the most important decisions of your life to chance or to a court.
